EPA Sues VF Corp For The North Face Claims

The US Environmental Protection Agency has filed suit against VF Corp for the sale of unregistered pesticides through The North Face.  The EPA claims that The North Face made unsubstantial health claims regarding unregistered products and their ability to control germs and pathogens. This is a violation of the Federal Insecticide, Fungicide and Rodenticide Act

At issue were more than 70 styles of footwear that incorporated an Agion silver treated footbed. The North Face made claims that the antimicrobial silver in Agion inhibits the growth of disease-causing bacteria and prevents bacterial and fungal growth. After being contacted by the EPA, The North Face has since revised their packaging.

Products that kill or repel bacteria or germs are considered pesticides and must be registered with the EPA prior to sale of distribution. Manufacturers should take note as I know The North Face is not the only company out there using silver and other "pesticides" as part of their clothing.
